User Agreement - Policies On Get It or Sell It

This web-site is intended to be a friendly, enjoyable and useful experience, but as with any kind of transaction there are risks involved and we strongly advise you to read and understand all of these terms before joining.

A key purpose of the terms and conditions set out below is to help you avoid falling victim to fraud. However, whilst we accept no liability for any losses suffered by one member because of the acts or omissions of another, should you follow these terms and our anti-fraud advice (below) and yet be unfortunate enough to be subject to fraud by another member, we will assist you as much as we can.

Terms and Conditions of Membership of www.getitorsellit.com (the site):

These terms apply to the contract between Getitorsellit.com Ltd (the company) and any business or individual registered with the site (the member). Use of this website constitutes acceptance of the Getitorsellit.com Ltd (The Company) Terms and Conditions. Members agree to be bound by the Terms & Conditions and operating rules and or/policies of Getitorsellit.com Ltd, as described below.

Conditions of Registration:

Only those who are over 18 years of age and are able to form legally binding contracts may register with the site.

Anyone holding themselves out as having that capacity that is later found not to be so capable will be immediately de-registered. Any business holding itself out as an individual and any individual holding him/herself out as a business will be immediately de-registered.

Members agree to:

Provide complete and accurate information upon registration

Use the site in accordance with these terms and conditions and the applicable law

Pay any agreed fees (in relation to administration or advertising)

Ensure that their participation in the selling or buying of items does not violate any applicable laws or regulations. By this we mean that each member must check that they are entitled to sell or buy the relevant item and that they are not prohibited from doing so by any law or regulation.

Use their best endeavours to follow the advice given on the site to help avoid fraud.

Members also agree not to:

Transmit through the site any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material.

Transmit any material that encourages conduct that could constitute a criminal offence, give rise to civil liability or otherwise violate any applicable law or regulation.

Membership Type: Private Individuals:

*Free for life, to Buy Sell or Exchange – for private individuals.

For private individuals, we offer a FREE for life ‘fair usage' policy. We do however reserve the right to change a membership from Private Individual to Business category, if it becomes apparent that ‘fair usage' far exceeds normal activity. This will be deemed as an infringement of our Terms and could lead to termination of membership. Please ensure you select the correct membership type when completing the registration form.

When you register, you will see that there is an ID Verification box. This box must be ‘checked' by all members wishing to sell. There is a small administration charge of £2.00 per verification for members that want to have their identification verified.

Site Fees:

Registration with the site is free to all members.

Selling and Buying or Exchanging is FREE* (With exception of the ID verification fee for members wishing to become sellers)

The Company reserves the right to add fee's for extra services in future to cover administrative costs, with adequate notice provided.

Membership Type: Business

Currently *Free for life usage for businesses to Buy Sell or Exchange.

Site Fees

The Company endeavours to keep to the policy of being totally FREE* to business members to buy sell/exchange. (With exception of the ID verification fee for any member wishing to become sellers) However, the Company reserves the right to commence charging fees for business users, to cover any administration costs in future. Respectful notification will be given.

Participation in auctions:

Private individuals may sell - bid for or exchange items via the site without charge. (With exception of the ID verification fee for members wishing to become sellers)

Any business wishing to advertise via the site will be charged a fee to be agreed separately in each individual case.

Your Conduct:

You are solely responsible for your actions on this website. You must ensure that your participation in the selling or buying of items does not violate any applicable laws or regulations. By this we mean that you must check that you entitled to sell or buy the relevant item and that you are not prohibited from doing so by any law or regulation. You must not transmit through the service any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material. You must also not transmit any material that encourages conduct that could constitute a criminal offence, give rise to civil liability or otherwise violate any applicable law or regulation.

Anti-fraud advice:

Sellers

in online auctions are strongly advised to take payment only by secure means, such as major credit cards or via secure gateways such as:

*Paypal, WorldPay, Protx, Nochex, Authorize.net, Moneybookers, Ikobo, 2checkout, Googlecheckout

Bidders

In such auctions are strongly advised only to bid for items where the sellers ask for payment by secure gateways, such as:

*Paypal, WorldPay,Protx,Nochex,Authorize.net,Moneybookers,Ikobo,2checkout,Googlecheckout

When buying from a business, bidders are also strongly advised only to buy from those businesses which make it clear in their own terms and conditions that online buyers are covered by the Distance Selling Regulations, which allow consumers purchasing products remotely a 7-day "cooling off" period, during which they may return the goods and obtain a refund of any money paid.

Selling Digital Content:

You may only upload to sell digital media i.e. audio, video, pictures (photographs) text and zipped up content and Software files if you have full copyright permissions and are the rightful owner or have permission to sell this material from the owner.

The Company accepts no liability for the media uploaded or downloaded on the site via the registered individuals.

If any abuse is bought to out attention (members uploading, downloading or placing obscene material on this site) content will be taken down immediately and appropriate action will be taken against the members/individuals responsible for the misconduct.

Rights To Suspend or Terminate:

The Company reserves the right to suspend or terminate any auction or use of any service available via the site immediately and without notice if it has reason to believe:

(a) any member is not abiding by the general rules of the site

(b) any member has repeatedly broken one or more of these terms

(d) any member is a non paying bidder.

In most cases where the Company suspects wrongdoing by a member, that member's account will be suspended whilst a full investigation is conducted. If that investigation confirms the member's wrongdoing, the member will be de-registered immediately.

Wrongdoing includes (but is not exclusive to) breach of any of the Terms and Conditions, especially in relations to dishonesty in violation of the terms and in relation to any service available via this website.

Limitations and Exclusions

The website acts as a window for sellers to conduct auctions and for bidders to bid on sellers' auctions. The Company is not involved in the actual transaction between bidders and sellers. It therefore has no control over and accepts no liability for the quality, safety or legality of the items listed the truth or accuracy of the listings, the ability of sellers to sell items or the ability of buyers to buy items the completion of transactions by bidders and/or sellers.

The Company accepts no liability whatsoever for:

Any items sold by Auction, any damage to items during transit or during the inspection period, nor for misrepresentations and/or breaches of contract by either buyer seller and/or exchanger.

The Company is not a party to any contract or other agreement between sellers and bidders. It can therefore accept no liability for any losses to any member under any such contract; however those losses might be caused, except where liability is imposed by law.

The Company will always use its best endeavours to ensure members comply with these terms of use, but it can accept no liability for any losses to any other member which may result from any member's failure to comply.

No advertisement displayed on the site is to be construed as a promotion or recommendation by the Company of any business or product. The Company accepts no liability for the acts or omissions of any member advertising on the site.

For the avoidance of doubt, the Company accepts no liability for any losses; however they may be caused, and by any act or omission of any where that act or omission is beyond the reasonable control of the company.

The company agrees to:

Use its best endeavours to ensure continuity of service via the site and to take all reasonable steps to ensure technical difficulties which cause interruption or disruption of any service provided via the site are remedied promptly.

General Terms:

This site acts as a window for sellers to conduct auctions, bidders to bid on sellers' auctions, and for members to exchange items.

The company is not involved in the actual transaction between buyers, sellers or exchangers. As a result, the Company nor administrators of the website www.getitorsellit.com has no control over the quality, safety or legality of the items listed the truth or accuracy of the listings, the ability of sellers to sell items, or the ability of buyers to buy items.

The Company cannot and does not control whether or not sellers will complete the sale of items they offer or buyers will complete the purchases of items they have bid on.

Please note that there are risks of dealing with foreign nationals, underage persons or people acting under false pretences.

The Company (nor any administrator/or employee of) will not be responsible for any items sold by auction, for any damage to items during transit or during the inspection period, nor for misrepresentations and/or breaches of contract by buyer, seller or exchanger.

The Company (nor any administrator/or employee of) shall not be responsible for the cost of procurement of substitute goods or any losses resulting form any goods purchased or obtained. The Company assumes no liability for the content of the listings on this website. However if you fall victim of a fraudulent transaction we will assist you as much as we can.

"We cannot accept responsibility for the processing of any personal data (as defined in the Data Protection Act 1998) uploaded by users of the relevant area of the website to sell their products. This does not affect any of the other conditions detailed in these Terms and Conditions."

Governing law:
